    Elastyczna formuła brytyjskiej konstytucji skutkuje względną otwartością na wpływy zewnętrzne. Tym niemniej, członkostwo Zjednoczonego Królestwa w strukturach Unii Europejskiej (1973-2020) skutkowało postępującym ograniczaniem doktryny suwerenności Parlamentu. Brexit nie odwróci skutków „miękkiego” modyfikowania fundamentów ustroju Zjednoczonego Królestwa, które częstokroć miały miejsce w sferze praktycznej realizacji kompetencji poszczególnych segmentów władzy państwowej. Prima facie, decyzja o wystąpieniu ZK z UE powinna skutkować „renesansem” tradycyjnej doktryny suwerenności Westminsteru w ujęciu Dicey'owiskim. Jednakże aktywizm sędziowski, dalsze obowiązywanie Europejskiej Konwencji Praw Człowieka (inkorporowanej na podstawie ustawy o prawach człowieka z 1998 r.) oraz nieodwracalne skutki powstałe w wyniku dewolucji kompetencji w ZK na rzecz Wali, Szkocji i Irlandii Północnej stanowią czynniki hamujące ewentualną rewitalizację zasady suwerenność parlamentu brytyjskiego.The flexible formula of the British Constitution results in a relative openness to external influences. Notwithstanding this fact, the United Kingdom’s (UK’s) membership in the European Union’s (EU’s) structures (1973–2020) resulted in a progressive limitation of the doctrine of parliamentary sovereignty. Brexit will not reverse the effects of the ‘soft’ modification of the foundations of the UK’s system, which occurred in the sphere of the practical implementation of the competencies of the branches of governance. Prima facie, the decision on the UK’s withdrawal from the EU should result in a ‘renaissance’ of the traditional doctrine of Westminster sovereignty, per A.V. Dicey. However, judicial activism, continued validity of the European Convention on Human Rights (incorporated on the basis of Human Rights Act 1998) and the irreversible consequences of the devolution of competencies in the UK for Wales, Scotland and Northern Ireland are the factors that hinder the possible revitalisation of the sovereignty of the British Parliament

    Transparency and government accountability in Brexit negotiations

    This chapter presents an analysis of the implications and the consequences of the United Kingdom’s (UK’s) decision to withdraw from the European Union (EU) in the context of the principle of transparency and the UK Government’s accountability in the Brexit negotiations. In political terms, the result of the 2016 Brexit referendum took on a particular role because its effects made it impossible for the UK Parliament to disregard the will of the people and in legal terms, the Her Majesty’s Government was unable to trigger Article 50 of the Treaty on the European Union (TUE). The outcome of the so-called Miller I case showed that the courts had been forced again to draw the boundaries of constitutional competence between the executive and the Parliament, in the sense that they had consistently backed Westminster. Thus, this chapter discusses that the credibility of the EU and the UK Government depended on the principle of transparency in the Brexit negotiations. The author argues that openness is a key element in ensuring accountability in the decision-making process. Taking into account the nature of the issue, it would be rational to expect both the EU and the UK to adopt a common approach to transparency, which was to result in increased responsibility

    On June 23rd, 2016, the United Kingdom (UK) held an EU-Referendum which resulted in a vote in favor of withdrawing from the European Union (EU). However, in a post-referendum reality, several constitutional issues have become apparent. On one hand, it is not certain whether the Prime Minister, under the royal prerogatives, can trigger Art. 50 of the EU Treaty. On the other hand, the scope of Westminster’s approval must still be determined. It is believed that the judiciary will end up in a constitutional crisis, especially the Supreme Court. At the very least, the suspension of ‘Brexit’ procedures is causing uncertainty on both sides i.e. UK and EU. This paper will pose some of the essential questions being discussed on the eve of the Supreme Court’s decision over ‘Brexit’ in December of 2016/January of 2017.W referendum przeprowadzonym 23 czerwca 2016 r. Brytyjczycy opowiedzieli się za opuszczeniem instytucjonalnych struktur Unii Europejskiej. Jakkolwiek w nieodległym czasie okazało się, że podjęta decyzja skutkować będzie szeregiem wątpliwości o konstytu-cyjnej proweniencji. Z jednej strony, zastrzeżenia związane są z zakresem kompetenc-ji premiera. Spór prawny odnosi się do oceny dopuszczalności samodzielnej notyfikacji instytucjom europejskim zamiaru wyjścia z UE (art. 50 Traktatu o Unii Europejskiej). Z drugiej strony, ewentualny zakres zgody parlamentu nie jest jasny i wymaga dalszej analizy. Stąd też nieocenioną rolę w tonizowaniu sporu kompetencyjno-konstytucyjnego w Zjednoczonym Królestwie przypisać należy sądownictwu. Dalsze wstrzymanie proce-dury opuszczenia UE jest, bowiem niekorzystne tak dla Zjednoczonego Królestwa, jak również dla UE. Stąd też w niniejszym artykule dokonano przeglądu pytań i wątpliwoś-ci, które wymagają uwagi w przededniu wyroku Sądu Najwyższego w sprawie Brexit

    VennDiagramWeb: a web application for the generation of highly customizable Venn and Euler diagrams.

    BackgroundVisualization of data generated by high-throughput, high-dimensionality experiments is rapidly becoming a rate-limiting step in computational biology. There is an ongoing need to quickly develop high-quality visualizations that can be easily customized or incorporated into automated pipelines. This often requires an interface for manual plot modification, rapid cycles of tweaking visualization parameters, and the generation of graphics code. To facilitate this process for the generation of highly-customizable, high-resolution Venn and Euler diagrams, we introduce VennDiagramWeb: a web application for the widely used VennDiagram R package. VennDiagramWeb is hosted at http://venndiagram.res.oicr.on.ca/ .ResultsVennDiagramWeb allows real-time modification of Venn and Euler diagrams, with parameter setting through a web interface and immediate visualization of results. It allows customization of essentially all aspects of figures, but also supports integration into computational pipelines via download of R code. Users can upload data and download figures in a range of formats, and there is exhaustive support documentation.ConclusionsVennDiagramWeb allows the easy creation of Venn and Euler diagrams for computational biologists, and indeed many other fields. Its ability to support real-time graphics changes that are linked to downloadable code that can be integrated into automated pipelines will greatly facilitate the improved visualization of complex datasets.     Anterior cruciate ligament (ACL) injuries have been a rising concern in the early years of the women\u27s Australian Football League (AFLW), eliciting headlines of a â € knee crisis\u27 surrounding the league. There has been a focus on female biology as the primary factor driving the high rate of ACL injuries in the AFLW. Emphasising Australian football (AF) as being dangerous predominantly due to female biology may be misrepresenting a root cause of the ACL injury problem, perpetuating gender stereotypes that can restrict physical development and participation of women and girls in the sport. We propose that an approach addressing environmental and sociocultural factors, along with biological determinants, is required to truly challenge the ACL injury problem in the AFLW. Sports science and medicine must therefore strive to understand the whole system of women in AF, and question how to address inequities for the benefit of the athletes. © © Author(s) (or their employer(s)) 2020.     THE INFLUENCE OF MUSCULAR ACTIVATION PROFILES ON LOWER LIMB BIOMECHANICS DURING A SPORT-SPECIFIC LANDING TASK

    The purpose of this study was to identify the muscular activation profiles utilised by female athletes during a sport-specific landing task, and examine the effects of varying profiles on biomechanical anterior cruciate ligament (ACL) injury risk factors. Muscular activation profiles were identified from electromyography data using a combination of principal component and cluster analysis methods, with the neuromuscular and biomechanical characteristics of profiles compared. Various muscular activation characteristics contributed to the presence of lower limb biomechanical patterns consistent with ACL injury risk factors. Reduction of ACL injury risk may be achieved by targeting these muscular activation characteristics via neuromuscular training programs
